US District Court Magistrate Jacqueline Chooljian of the US District Court Central District of California said in her 48-page order on May 16 that she has reviewed all the documents related to both the parties. and considered the arguments presented. After this, the court has come to the conclusion that the crimes under which extradition was sought for Rana, he is eligible for that extradition. The last hearing in this case was held in June 2021. Despite presenting all the arguments and filing documents, the matter was pending for 2 years.
Now India can surround Pakistan
After the US Secretary of State takes a decision on the matter, Rana’s custody will be handed over to the National Investigation Agency (NIA), which is probing the matter. Rana’s case on India 26/11 case will prove to be helpful for India to surround Pakistan.
Extradition was cleared in 2020 itself
In 2020 itself, it was said in a California court that Rana’s extradition to India should be approved because the charges against him and the legal status meet all the criteria of the extradition treaty between the two countries. On September 2020, Christopher D. Greg (Chief of the National Security Division of the US Attorney’s Office) and Attorney Nicola T. Hanna argued in a California court that Rana’s earlier arguments against his extradition to India had no merit . Along with this, it was also said that all the qualifications related to Rana’s extradition match. Along with this, according to the extradition treaty, this extradition is completely legal under the charges against him in India. And there are reasonable arguments to believe that Rana himself has committed these crimes.
Interestingly, however, the US government had maintained that it would not pursue charges such as ‘member of a terrorist organisation’, ‘conspiracy to wage war’ and ‘conspiracy to commit terrorist acts’. Whereas India had put pressure for this. America said that the need for an extradition treaty has been fulfilled.
When was the application for extradition
In December 2019, India applied for Rana’s extradition through the Ministry of External Affairs. After this, in June 2020, on the request of NIA, Rana was taken into custody. He was then released early from a US prison where he was serving a sentence for conspiracy to attack the offices of the Danish newspaper Jylland Posten. On August 2020, an application for his extradition was filed in an American court. And the hearing of this case started in January 2021.
26/11 accused Headley was a childhood friend
Rana was accused of helping his school friend David Coleman Headley who is an accused in the 26/11 case. Rana was alleged to have not only supported Headley in this conspiracy but also showed him as an employee in his visa facilitation company and also opened an office in Mumbai as his cover in India. In the court as well, Rana argued that he had been acquitted by a California court in 2011 of Mumbai terror attack charges and since Headley had not been extradited, he could not be extradited either. .
Not only this, the documents submitted related to the case stated how between June 2006 and November 2008, Headley traveled to Chicago at least three times and met Rana during this period, and informed him about his activities in Mumbai. Detailed information was also given about it. Not only this, Headley also arranged for Rana to meet one of his co-conspirators (from Pakistan) in Dubai. The same conspirator warned Rana not to travel to India because of the upcoming attacks. That’s why Rana did not travel to India.

In September 2009, the FBI intercepted a conversation between Rana and Headley in which Rana was found to have allegedly told Headley that the nine LeT attackers killed during the attacks were given the Nishan-e-Haider, Pakistan’s highest military award. should go. Not only this, on December 25, 2008, when one of the conspirators wanted to know the condition of Rana from Headley, Headley’s reply was that he is completely relaxed and not scared at all. Court documents also state that Rana was so fearless that he would sometimes speak directly to some of Headley’s contacts in Pakistan. He was also in direct contact with Headley’s associates.
